The Code of Civil Procedure authorizes judgment liens on real property to enforce money judgments such as those incorporating the provisions of a marital settlement agreement, a property division order, or a judgment for attorney's fees. The lien is created by recording an abstract of judgment.

A Divorce lawyer will assist you in filing Certification of abstract of judgment. The procedure is as follows, an abstract of a judgment ordering a party to pay spousal, child, or family support to the other party shall be certified by the clerk of the court where the judgment was entered.

The Divorce Attorney will make sure the judgement will contain the following, the title of the court where the judgment is entered. Also the date of entry of the judgment and any renewal date. In addition, the judgment must have the name and last known address of the party ordered to pay support.

Also the judgment must have the name and address of the party to whom support payments are ordered to be paid which would be any person receiving or trying to receive money.

Judgment includes an order for child, family, or spousal support.

At the Law Office of David Schwarz we will assure our client that once the obligation to pay what is owed in the judgment is paid off the appropriate procedures are done to relinquish the lien from the real property. An Orange County filing regarding the abstract of a support judgment may be extinguished by the recording of an acknowledgment of satisfaction or a certificate of satisfaction issued by the court clerk.

A Divorce Lawyer will properly prepare a real property lien If it is to enforce a judgment for child, family, or spousal support payable in installments. The lien may be created by recording an abstract, a notice of support judgment, a certified copy of that money judgments with the county recorder

A judgment lien on real property can also be imposed directly on specific real property by the terms of the judgment itself. This means the divorce judgment can refer to real property outside the judgment that can be enforced by the judgment itself rather than a lien.

A judgment lien on real property created by recording an abstract of judgment continues for 10 years. A judgment lien on real property may be renewed by recording a certified copy of an application for renewal. A renewal extends the lien for 10 years from the date of the filing of the application for renewal. However, these general rules do not apply to judgments or orders made or entered pursuant to the Family Code.
