Mother of Nipsey Hussle’s 10-year-old daughter wants child ‘back in her life’ amid guardianship battle

Nipsey Hussle sadly passed a few months ago from gun shot wounds.  He left behind a daughter whom is now resides with the family of Nipsey Hussle.  A Petition for guardianship has been filed in Court by Nipsey’s sister.  A Guardianship works similarly like a child custody action in family law court.  The Court uses the best interest standard to determine what is best for the child.  It is similar to a family court proceeding.

Tanisha Foster is the biological mother of Nipsey’s child.   Nipsey Hussle’s sister Samantha Smith filed a petition for guardianship over Nipsey’s daughter, was assigned to a different judge for an initial hearing Friday afternoon.

The judge cleared the courtroom and allowed the mother and daughter to spend 20 minutes together alone in the gallery. Foster wiped away tears as she left the emotional reunion.

Foster and Hussle shared custody of Emani Dior Angelique Asghedom before the rapper’s shooting death on March 31, Lewellyn confirmed.

Nipsey had primary custody of his daughter but had a good relationship with the mother of the child. She would often visit her daughter without any problems between the two.

In her highly redacted paperwork, Smith said her niece “requires” a guardian now that Hussle is gone and that she’s the “best person” for the job.

Samantha believes Emani’s biological mother is unfit to care for the 10-year-old, and Samantha played a crucial role in helping raise her when Nipsey was alive. Samantha wrote that she wants to “ensure the continued stability for Emani and ensure that she will be able to maintain her current and ongoing relationship” with her fam.

Hussle’s brother Samiel Asghedom said he supports Smith’s petition and was by Smith’s side at the hearing Tuesday.

Smith initially asked for emergency temporary guardianship of Emani but was denied the request pending notification of Foster and a hearing.

In her paperwork, Smith said she lived with Hussle and Emani for the first half of the little girl’s life and “assisted” with the child’s care on a “consistent” basis after that.

“(Smith) and the rest of Emani’s paternal family want to ensure the continued stability for Emani and ensure that she will be able to maintain her current and ongoing relationship with (her) paternal family members with whom she is close and upon whom she has always relied,” the filing said.

Ultimately the court ruled the daughter of Nipsey, Emani, will not go back to her fathers family amid biological mothers objections.

Often in Guardianship cases although one party might get custody of the minor child, the court will offer visitation to the objecting party.  In this case it is biological mother who will get visits with her daughter. The Court probably felt that the best interest of the child would be to have the child reside with Nipsey’s family.

Often these type of guardianship cases that are high profile or contain information that is confidential will be closed to the public.  These are called closed hearings.  The daughter of Nipsey as well has a say in the proceeding.  She is 10 years old and will be able to voice her opinion as to where she wants to live.
