Types of Guardianships in California

If parents are unfit to care for their child, it may be possible for a relative, such as a grandparent, to seek guardianship over the child. A guardianship can help the child stay out of foster care and allow you to provide the child with the love and support he or she deserves.

At the Law Offices of David P. Schwarz, we help clients seek guardianships over minor children in Orange County. We provide compassionate support and guidance to families in matters involving guardianships, dependency, child support and custody.

Understanding the Different Types of Guardianships

In California, there are three types of guardianships: guardianship of the person, guardianship of the estate and guardianship of the person and the estate. At our firm, we focus our practice on helping families secure guardianship of the person over a child.

There are also two different types of guardianship over the person:

  • Temporary guardianship: To gain temporary guardianship over a child, you must show that you are a suitable provider and that the current living situation is not in the child's best interest. For example, in a juvenile dependency case, where a parent is fighting to regain custody of his or her child, a relative may step in to keep the child out of foster care during the case.
  • Permanent guardianship: When a parent is no longer fit to care for his or her child, a relative may seek permanent guardianship. This can allow you to care and support the child into the future and avoid having the child become loss in the foster care system.

Whether you are seeking a temporary or a permanent guardianship, we can help you understand your options and seek the guardianship that meets your family's needs.
